SCOPE OF SERVICES


1. Service Offerings: MyHindTech Solutions Pvt. Ltd. specializes in a range of digital solutions including custom software development, IT consulting, digital transformation, and bulk SMS services. We may also offer supplementary services as outlined in specific service agreements.

2. Changes to Services: We reserve the right to modify, suspend, or discontinue any part of our services at our discretion. We will notify users of significant changes that impact their existing service agreements.



USER RESPONSIBILITIES AND OBLIGATIONS


We use this data to make our services work better for you. Here’s how:

1. Compliance with Laws: Users agree to comply with all applicable laws, rules, and regulations while using our services.

2. Providing Accurate Information: Users must provide accurate and current information when registering and using our services. This includes keeping contact and payment information up-to-date.

This means that while we strive for quality, we don’t provide any warranties or guarantees about our services. Specifically, we do not guarantee that our services will always be free of errors, secure, or available without interruptions.

We also want you to know that any information or advice you receive from our team—whether it’s verbal or written—should not be considered a warranty. It’s important not to rely solely on this information for making decisions, as it may not always be accurate or complete.

Additionally, MyHindTech Solutions and our partners cannot be held responsible for any costs or damages that may arise, directly or indirectly, from using our services or engaging in transactions related to them.

Bankruptcy or Insolvency Notice
In the unfortunate event that a customer faces insolvency or if a bankruptcy petition is filed by or against them, MyHindTech Solutions reserves the right to terminate our services immediately. This will be done without prior notice or penalty. If this situation arises, the customer agrees to allow us to proceed without the usual protections that might otherwise delay our ability to take action.



LIMITATION OF LIABILITY

To the maximum extent permitted by law, MyHindTech Solutions Pvt. Ltd. wants to be clear about our limitations regarding liability. This means that we, along with our executives, directors, employees, and partners, cannot be held responsible for any losses you might face. This includes:

1. Loss of Domain Name: If you lose access to your domain name for any reason, we are not liable.
2. Business or Personal Losses: This covers any financial losses, whether related to your business or personal matters.
3. Revenue Decrease: If your income drops as a result of using our services, we cannot be held accountable.
4. Increased Expenses: Any additional costs you incur while using our services are your responsibility.
5. Costs of Substitute Products: If you need to purchase other products or services to replace what we offer, we are not liable for those expenses.
6. Other Losses or Damages: This includes any indirect or unexpected damages that arise from using or being unable to use our services.

Even if we have been informed about the possibility of such losses, we will not be liable for special, incidental, punitive, or indirect damages.

In the unlikely event that MyHindTech Solutions is found liable for any reason, our total responsibility to you or any third party will be limited. Specifically, we will only be liable for the actual amount you paid for our services in the three months prior to when the issue occurred. This means that you will not be able to claim more than what you paid us in that time frame.



TERMINATION OF SERVICES

1. Termination by User: Users may terminate their use of our services by providing a written notice, following the terms specified in their individual service agreement.

2. Termination by Company: MyHindTech Solutions Pvt. Ltd. reserves the right to suspend or terminate access to services at any time, especially in cases of policy violation or unpaid dues.

3. Effects of Termination: Upon termination, all rights and obligations granted to the user under these Terms will cease, except for provisions that by nature or regulation should continue after termination (e.g., confidentiality and intellectual property rights).



GOVERNING LAW AND DISPUTE RESOLUTION

The Terms of Use (TOU) and any other agreements related to MyHindTech Solutions Pvt. Ltd. services will be governed by the laws of the State of Haryana, India, without considering its conflict of laws principles. If any disputes arise between you and MyHindTech Solutions, any legal action or arbitration will take place in the district court of Kanpur. By using our services, you agree to this jurisdiction. If any part of the TOU or other agreements is found to be unenforceable by a court with proper authority, the rest of the agreement will still remain valid and in effect.

1. Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.

2. Dispute Resolution: ,In the event of any disputes arising from these Terms, both parties agree to seek an amicable resolution. If unresolved, disputes shall be resolved in the courts of Kanpur.



ENTIRE AGREEMENT AND EXCLUSIVITY

The Terms of Use (TOU) and any specific agreements related to the services of MyHindTech Solutions Pvt. Ltd. encompass the full understanding between us and our customers. Unless we have explicitly stated otherwise in a signed document from an authorized representative, the TOU will take precedence over any prior written agreements (including digital formats), verbal agreements, or implied understandings.

These agreements are intended solely for MyHindTech Solutions and our customers, and they do not grant any rights to third parties, except where explicitly indicated by us.



MODIFICATIONS

At MyHindTech Solutions Pvt. Ltd., we are committed to continually improving our services to better meet your needs. This may involve updating, upgrading, replacing, or modifying any software, applications, programs, data, hardware, or other components that support the services we provide. While we aim to enhance your experience, please be aware that these changes might impact how your personalized applications and content function.

We want to remind you that you are fully responsible for managing your customized applications and content. This means that if any issues arise due to changes we make, MyHindTech Solutions Pvt. Ltd. cannot be held liable unless we have specifically agreed to take responsibility for those issues in writing. We encourage you to keep this in mind as you use our services.



DATA BACKUP

We cannot stress enough the importance of data management and backup. Unless we have a written agreement that states otherwise, you are entirely responsible for managing and backing up all your data. This includes ensuring that your data is safe and secure, as well as keeping it up to date.

MyHindTech Solutions Pvt. Ltd. does not take responsibility for backing up your data or for any updates, upgrades, or patches related to the software you use in conjunction with our services. It’s crucial to regularly back up your data to avoid any potential loss, and we recommend implementing a robust data management strategy to protect your information.



THIRD-PARTY LICENSES

As part of our commitment to providing you with cutting-edge technologies, we work hard to source innovative developments from various third-party providers. These technologies may include software, applications, or tools that enhance the services we offer. However, it’s important to note that while we strive to deliver high-quality technologies, we do not guarantee their quality, accuracy, reliability, or ongoing availability.

Furthermore, we specifically disclaim any warranties regarding the merchantability or fitness for a particular purpose of these technologies. If a license we have obtained from a third party is revoked or terminated, you agree that MyHindTech Solutions Pvt. Ltd. is not liable for any consequences that may result from this. Your use of these technologies—whether you obtain them directly from us or through another source—is at your own risk. We recommend that you evaluate the suitability of these technologies for your needs before use.



AMENDMENTS TO TERMS AND NOTIFICATIONS

MyHindTech Solutions Pvt. Ltd. reserves the right to modify these Terms at any time. If any significant changes are made, we will notify users via email or within our platform. Continued use of our services after such changes will signify your acceptance of the updated Terms.



HERE’S EVERYTHING YOU NEED TO KNOW ABOUT OUR BILLING POLICY

We’re excited to have you with us! Our Billing Policy applies to all MyHindTech Solutions customers, so let’s dive into the details:

Payments Made Easy
All charges are displayed in Indian Rupees (INR), and we accept payments in the same currency. Here are the ways you can pay:
  Cheque or NEFT
  Bank Transfer

Payments are due on your Account Statement Date, which is the monthly anniversary of when you activated your account. If you've shared your credit card details with us, you’re giving us permission to automatically charge your card for any fees related to your account. These recurring charges will continue until you decide to cancel in line with our Billing Policy.

If your account incurs charges exceeding INR 500.00, we’ll automatically charge your card on the next Account Statement Date. Please remember to keep us updated on any changes to your credit card information, such as the number, expiration date, or billing address. If you're not using a credit card, we kindly ask you to settle your balance within 20 days of the Account Statement Date. Accounts overdue by 45 days will be suspended, and any unpaid balances may incur collection fees, including attorney and court costs.

Flexible Billing Cycles
We offer yearly billing cycles for our hosting services, starting from the date your plan is activated. Resellers have the option of monthly billing for their charges, while non-credit card payments are available on an annual or quarterly basis. Feel free to switch your billing cycle at any time; just note that the change will take effect with your next plan renewal.
Automatic Account Renewals
To ensure your website runs smoothly without interruptions, all plans automatically renew at the end of each billing cycle. Renewal charges are based on the current rate for the selected service. If you want to cancel your plan, please check the cancellation section below.
Important Note:
Domain registrations and web hosting accounts are managed separately. If you need to cancel, let us know if you're canceling just the domain, just the hosting, or both. Keep in mind that canceling your domain doesn’t automatically terminate your hosting account and vice versa. Your hosting account will renew automatically unless you inform us otherwise.

We do not send paper invoices. You can request your statements anytime by emailing us at billing@myhindtech.com.

Fees You Should Know About
Returned Cheques
A fee of INR 500.00 will apply for returned (NSF) checks. Future payments will need to be made via certified cheque.
Bank Transfers
We don’t charge fees for bank Transfer, but international transfers might incur a processing fee from an intermediary bank. Please account for this when sending your payment.
Reactivation Fees
If you want to reactivate a closed account, a fee of INR 500.00 will apply, and INR 2000.00 if we need to restore your data files.

Plan Changes
Downgrade Fee
Switching to a lower-priced plan on the same platform incurs an INR 600.00 fee.
Upgrade Fee
There’s no fee for upgrading to a higher-priced plan, but you’ll need to cover the difference in setup fees.
Platform Change Fee
Changing to a different operating system will result in an INR 600.00 charge.

Cancellations
Hosting plans renew automatically unless canceled. To cancel your service, please reach out to our Customer Relations Team at info@myhindtech.com. Our specialists are here to guide you through the cancellation process.

Keep in mind that there are no prorated refunds after the first 30 days of service. Cancellation requests should be submitted at least 30 days before the end of your billing cycle to avoid automatic renewal. We’ll confirm your cancellation request once processed. If you don’t receive confirmation, please contact us promptly.

Please note that we don’t monitor for issues related to domain transfers or other secondary problems that aren’t directly tied to our services. Cancellation does not absolve you of any outstanding balances on your account.

30-Day Money Back Guarantee
We want you to be happy! That's why all our shared hosting plans come with a 30-day unconditional money-back guarantee. If you’re not satisfied with our services or support within the first 30 days, you can request a full refund (excluding setup fees) upon cancellation. Please note that certain services, like domain registrations and dedicated servers, do not qualify for this guarantee.

Refund Policy
Refunds are only available under our 30-Day Money Back Guarantee and will be processed using the same method you used for your original payment. After 30 days, refunds will not be offered.

Price Changes
We’re committed to transparency, but please be aware that our policies and prices can change without prior notice. Any changes will take effect in the following billing cycle.
